UPC en acción: experiencias recientes desde la perspectiva de la industria

PONENTES:

Fernando Rey (Senior manager IP at Carrier Corp.)

Los ponentes presentarán sus experiencias en acciones ante el Tribunal Unificado de Patentes (Unified Patent Court, UPC) desde la perspectiva de la industria, ya sea como demandantes (titulares de patentes) o como demandados.  En particular se tratarán casos de HP Inc. y Carrier Corp. en los que los ponentes han sido los responsables en sus respectivas empresas.

Desde la perspectiva de in-house counsels, se mostrarán los procesos de litigación de patentes desde el inicio hasta el final (o hasta donde se haya llegado). Desde el mismo punto de vista, se discutirán ventajas y desventajas, así como las tempranas señales de jurisprudencia emergentes de estos casos.

Entre otros posibles, se tratarán los siguientes aspectos:

- Elección del UPC y comparación con litigios nacionales

- Presentación de la demanda

- Selección de la corte del UPC y del idioma

- Duración del litigio

- Apelación
